When two people have a child together but are not married, several types of legal problems may need to be resolved if they separate. At Allen, Miller & Diaz, P.A., we have more than 35 years of family law experience representing clients throughout Central Florida, and have helped many parents obtain favorable outcomes to their paternity, custody and support disputes. Contact us to schedule an appointment to discuss your situation. Together, we can develop a plan that works for you and your child.

Paternity Actions

We represent mothers and fathers on both sides of paternity actions. When the identity of a child's father is unknown or uncertain, the paternity of the child is in question. A mother can bring a paternity action, or a father may need defense of a paternity action. The child's paternity can be established through a DNA test — often a cheek swab test. Once paternity is established, the father can then obtain parental rights to custody and visitation. Additionally, the father may become responsible for paying child support.

Other Legal Concerns of Unwed Parents

As family law attorneys, we also help mothers and fathers in situations where the father is known but the parents are not married. Various scenarios can exist. For example, the unmarried couple may share a child and cohabitate for many years, only to have the relationship end. Or, the couple may never live together but be in a relationship that eventually ends. In either scenario, the need may arise for the parents to come to a legal agreement involving child support, custody and visitation.

As your attorneys, we consistently uphold your parental rights and the best interests of your child or children.
